As either a tenant or a landlord you should always ensure you use an ARLA registered agent. At present there are no laws or legislation to stop anyone setting up a letting agency therefore there is an undercurrent of unregulated agencies in our industry. As a registered agent we have a strict code of practice to follow which is set down by The Property Ombudsman this relates to the way we conduct business.
We are obliged to treat all of our clients professionally and fairly at all times and if any of our clients feel unhappy about anything we have done they have the right to complain and seek help from a regulatory body. The ARLA membership secures tenants and landlords further by bonding our client account and annually auditing our accounts to ensure client money is not being used illegally.
The pitfalls of using an un-registered agent can be very expensive and also very painful. Imagine if your agent treated you unfairly and withheld money from you that was rightfully yours. Who would you turn to? Are there any laws to protect you? The answer unfortunately is that there is not anything that safeguards you if you fall foul of an unregistered agent.
It is a common occurrence for un registered agents to go out of business with the owner's absconding with thousands of pounds of client's money. It is even more common for tenants and landlords to feel aggrieved by the poor standards of service that these sort of letting agents provide. When you choose your letting agent always look out for the ARLA logo and double check the ARLA website to verify your agent is registered.
